Whereas the Municipal Act, 2001, as amended (the "Act"), provides councils with the authority under Section 238 to govern their own procedures concerning meetings and decision-making processes; and Whereas Council's Procedural By-law stipulates that a motion may be reconsidered only at the next meeting following its original adoption; and Whereas Council finds it necessary to waive Sections 14.10 (a), (b), and (c) of the Procedural By-law to allow for the reconsideration of Motion COU-2024-94 on March 25, 2024, acknowledging that while staff cannot unsend original correspondence, Council retains the authority to change its position, and under Section 3.1 of the By-law, Council may suspend the rules with the majority vote; Therefore, be it resolved: That Council hereby waives the procedural requirement to reconsider and rescind the motion on March 25, 2024, related to Council's position. That based on resident and visitor opposition, and new information presented, Council resolves to:  Direct staff to write to the Minister of Environment and Climate Change Canada retracting the original request and affirming Brighton's support for Mute Swans remaining a protected species under the Migratory Birds Convention Act and all relevant federal legislation and regulations.  Forward a copy of this correspondence to Phil Lawrence, member of Parliament for Northumberland-Peterborough South.  Advise the Canadian Heraldic Authority that the Municipal Coat of Arms may remain unchanged. 

Whereas section 11 (3) (9) of the Municipal Act, 2001 gives municipalities the ability to create and enforce bylaws related to animal control; and Whereas the Municipality of Brighton currently has a bylaw with relation to the control and ownership of dogs, but not cats; and Whereas bird populations have been in sharp decline for decades, having a negative impact on entire ecosystems, with outdoor cats responsible for an estimated 100-350 million bird deaths per year in Canada; and Whereas Brighton is known as a destination for birders, and many Brighton residents enjoy birdwatching; and Whereas many Brighton residents enjoy gardening, and experience the nuisance of having outdoor cats digging and defecating in their garden beds; Therefore be it resolved that council direct staff to investigate and bring a staff report, on or before the second regular Council meeting in February, on a pet control bylaw that includes humane best practices in reducing cat roaming and predation.
Moved by Councillor Jeff Wheeldon, seconded by Councillor Bobbi Wright
Carried
Whereas the Municipality of Brighton's internal policy requires council approval for out-of-province conference attendance; and Whereas the Federation of Canadian Municipalities holds a Sustainable Cities Conference every other year, supporting municipalities in climate change mitigation and adaptation; and Whereas Councillor Wheeldon attended the FCM SSC two years ago, and found it to be very helpful in preparing for climate action in Brighton, including gathering materials and support for adding climate action as an important part of our Strategic Plan and the steps the Municipality has taken since then; and Whereas one of the sessions at the 2025 conference, to be held in Fredericton in February, is specifically about regional collaboration in climate action, a critical lesson at a time when Northumberland County and its respective lower-tier municipalities are attempting to develop climate action plans that are mutually supportive; therefore Be it resolved that council supports Councillor Wheeldon attending the FCM Sustainable Cities Conference in Fredericton, New Brunswick, February 10-13 2025.
