Council PLANNING Meeting

That Council approve the May 8, 2023 Planning meeting agenda as presented.

That Council move into Statutory Public Meeting May 8, 2023 at 6:34 p.m.

That the report of the Planning and Development Department, dated May 8, 2023, regarding Zoning By-law Amendment Z01-2023 (Brighton Gateway - 8597685 Canada Inc.) be received; and, Further That Council enacts a By-law to rezone the subject lands as described as Part of Lots 1 and 2, (South Side Main Street) of Registered Plan 28, Parts 1 and 2 of Plan 39R13950, as provided as Attachment #4 to this report.

That Council move out of Statutory Public Meeting May 8, 2023 at 7:33 p.m.

That Council receives and directs Staff to amend the report dated May 8th, 2023, regarding the Municipality entering into a subdivision agreement for Applewood Subdivision – Phase 3 (File No. SUB2021-02); And That Council give final approval to the draft Subdivision M-Plan for Phase 3 of Applewood Subdivision – (File No. SUB2021-02) comprised of thirteen (13) single-detached lots, 4 semi-detached units, eighteen (18) townhouse units for a total of 35 residential units, together with Blocks for reserves and required easements under authority of Section 51(58) of the Planning Act; and that the finally approved M-Plan be registered within 30 days of the date of approval; And That the By-law be enacted, to authorize a Subdivision Agreement between the Corporation of the Municipality of Brighton and the Owner, #8597685 Canada Inc. for the Phase 3 – Applewood Subdivision; And That the Mayor and Clerk be authorized to sign the Subdivision Agreement; And That staff be directed to make any necessary infrastructure design drawings revisions as may be necessary to be in keeping with good engineering practices; And That Council authorize the Municipal Solicitor to include any legal descriptions or other revisions as required for registration, and to register the finally approved Subdivision M-Plan and Subdivision Agreement.

That Council receives and directs Staff to amend the report dated May 8th, 2023, regarding the Municipality entering into a subdivision agreement for Butler Creek Subdivision and Condo (File No. SUB2021-01) – Subdivision Agreement and Registration; And That Council give final approval to the draft Subdivision M-Plan for Butler Creek Subdivision and Condo (File No. SUB2021-01) comprised of nine (9) single detached dwelling residential lots, sixteen (16) semi-detached residential lots, and twenty-one fourplexes (eighty-four (84) dwelling units) in a condominium block for a total of 109 residential units and a street extension (Meadowcreek Drive), together with Blocks for parkland and reserves; And That the finally approved M-Plan be registered within 30 days of the date of approval; And That the By-law be enacted, to authorize a Subdivision Agreement between the Corporation of the Municipality of Brighton and the Owner, #2020910 Ontario Ltd. for the Butler Creek Subdivision and Condominium; And That the Mayor and Clerk be authorized to sign the Subdivision Agreement; And That staff be directed to make any necessary final design drawings revisions as may be necessary to be in keeping with good engineering practices; And That Council authorize the Municipal Solicitor to include any legal descriptions or other revisions as required for registration, and to register the finally approved Subdivision M-Plan, refence plans, and Subdivision Agreement.

That Council gives a bylaw its first, second and third reading and finally passes on this date: Being a by-law under the provisions of Section 34 of the Planning Act, R.S.O., 1990, to amend By-law No. 140-2002, as otherwise amended, of the Corporation of the Municipality of Brighton as it applies to the lands described as Part Lots 1 and 2 (South Side Main Street) Plan 28, Parts 1 and 2 of Plan 39R-13950; Subject to an Easement As In ND177859; Subject to an Easement As In ND221315; Municipality of Brighton.

That Council gives a bylaw its first, second and third reading and finally passes on this date: Being a by-law to authorize the Mayor and the Clerk to execute a Subdivision Agreement between the Corporation of the Municipality of Brighton and #8597685 Canada Inc. regarding Phase 3 of a plan of subdivision
